简论中国国际私法立法完善的构想

摘  要
 当今我国国际私法立法因指导思想上存在误导，实践上存在不良习惯，致使立法现状不甚理想，很多方面亟待完善。如立法体例落后，内容残缺不全、相互矛盾和重复累赘。面对世界国际私法在全球化背景下有了一系列新发展这一形势，笔者结合世界国际私法的发展趋势及我国国际私法的立法现状，从我国现有经济地位、法律环境等具体国情出发，对完善入世后中国国际私法立法进行前瞻，并就相关问题提出自己看法和建议。认为在《中华人民共和国国际私法示范法》基础上进行国际私法法典立法，可解决我国国际私法立法困境。且我国国际私法法典立法时机比较成熟，条件基本具备，该方案也基本可行；不过有些方面还仍需创新发展，如立法思想上还应树立社会公益本位观念。

 On the Legislative Plan of Chinese IPL
Abstract
     Because of the misleading of directing and bad custom of practice, the current legislation of Chinese International Private Law is not satisfying, thus the perfection of its legislation is in urgent need. Such as the legislation of CIPL goes with backward style, imcomplete, contrary and burden contents. In the time of globalization, the world International Private Law has many new tendencies of development. Integrating the trend of the world International Private Law in nowadays and the current situation, background of the legislation in China, the author tries to envision the possibilities of improving the legislation of Chinese International Private Law after China’s access to WTO and further propose personal view points as well as suggestions for the existing problems. Facing with the economic and legal environment of China this times, the author point out that the best way to resolve the difficulties is to draw up the code of IPL based on “Model Law on IPL of PRC”. It’s time to work out a code of CIPL, and there are many aspects in the field of practice need innovating. For exemple, we should put all world people’s benefits above national benefits.
