摘要
破产重整制度顺应经济规律与市场变化的要求，突破传统的破产清算制度与破产和解制度，独树一帜，在新时代的经济环境中发挥其重要作用。在公平清偿债务人的财产与挽救濒临破产企业的双重目的基础上，重整制度解决了相关可能引发的各种社会问题，从而维护了社会整体利益。但我国新引进的破产重整制度在各方面都较为薄弱，所以笔者认为对破产重整制度法域归属的讨论则可以为重整制度之路指引一盏明灯，越早对重整制度予以准确的界定，重整之路就会越早步入正轨，扫清在破产重整中出现的障碍，使重整制度在破产过程中发挥其功效。本文从重整制度的价值理念、基本原则、调整对象与调整方法、性质与特点等方面结合经济法内容，探讨重整制度的经济法属性。

Discussion on the bankruptcy reorganization of the system’s attributes of Economic Law
Abtract
     Bankruptcy restructuring system complies with the requirements of the economic laws and the changes of market. It plays an important role in economic environment of the new era which breaks through traditional bankruptcy liquidation and insolvency reconciliation system,and has own features. On the basis of dual objects which enable solving the equitable settlement of the debtor’s property and saving the brink of bankruptcy enterprises, restructuring of the system solves the social problems which are caused by possibly, thus it maintains the overall interest of the community. But chinese new bankruptcy restructuring system introduced in all areas are relatively weak. Therefore,I believe that bankruptcy restructuring system jurisdiction vested in the disscussion of re-engineering system that can be the road to guide a light.the sooner the restructuring of the system to be accurately defined,the sooner the restructing of the road will be on the right track.Behind clearing the obstacles in the bankruptcy reorganization,it makes the restructuring of system in the insolvency process playing its effectiveness. Related to the areas of economic law, from the restrucuring of the system of values,basic principles,targets and adjustment methods,nature and characteristics, This article will discuss the system of the attributes of economic law on restructuring.
