探析盗窃代币卡犯罪既、未遂的认定

摘   要
     在中国，随着市场经济的发展,由传统的购物券演变升级形成的代币卡在一些商场等消费场所流行开来。代币卡的发展,给传统的货币政策操作体系、传统的银行信贷制度安排、金融运行安全性等方面带来许多新的风险。同时也影响到我国刑法适用领域，给法律实务工作带来诸多新的问题和挑战。在遵循罪刑法定原则的基础上，运用传统刑法理论对以代币卡为犯罪对象的盗窃犯罪问题进行探析，既是保护公私财产的要求，也是刑法规范现实调整和刑法理论更新的迫切需要。本文在参考和借鉴国内学术界现有研究后，结合我国刑法和司法解释中的有关规定，对盗窃代币卡犯罪既遂、未遂认定问题、量刑问题等进行论述并提出见解。
本文共分三个部分。第一部分，盗窃代币卡犯罪的现状。介绍代币卡的发展状况、定义以及盗窃代币卡犯罪的危害性。第二部分，盗窃代币卡犯罪既、未遂认定标准研究。第三部分，盗窃代币卡犯罪中既、未遂行为分别独立成罪的特殊情形和量刑幅度把握。

On the holding of consummated crime and criminal attempt in the larceny of steal the debit cards
Abstract
Traditional purchasing coupons have been evolved and replaced by debit cards which become more popular in most stores in China as the market-directed economy being further introduced. Accompanying risks caused by the development of debit cards which face traditional currency policy operation system, both traditional bank loan system and monetary and banking security have impacts on applications of the criminal law of China. It hence becomes problematic and challenges the practical adaptations of laws.
On the basis of the principle, “a legally prescribed punishment for a specified crime”, and traditional criminal theory and criminal legislation, probing the issues on debit card crime is not only a requirement to protect the public and private assets, but also an urgent demand for feasible adjustment of the standard of criminal law and the development of the theory of criminal law. Drawing on literatures and referring to China’s criminal law and relevant stipulation of judicial interpretations, this paper discusses attempt or accomplishment, measurement of penalty in the larceny of steal the debit cards, and provides recommendations.
The whole paper has three parts. Part one, the current situation of the larceny of steal the debit cards, introduce the development and definition of debit cards, and the harmfulness of the larceny of steal the debit cards. Part two, the research on consummated crime and criminal attempt in the larceny of steal the debit cards. Part three, the peculiar circumstance and the range of measurement of Penalty on the behavior of attempt or accomplishment ready-made crime respectively in the larceny of steal the debit cards.
