浅析非法行医罪

摘    要
      近几年来，随着我国社会主义市场经济体制的建立、健全，医疗卫生的改革在很大程度上方便了广大群众就医，弥补了国家医疗服务的不足。行医是关系到人民群众生命健康的特殊职业，因此，国家对这一行业的管理极为严格。不仅对行医者的资格加以严格限制，要求行医者必须要有良好的政治思想条件外，还须具备一定的技术资格，以保证医疗质量，保障人民群众的生命健康安全。而且还对行医活动，制定了一套严谨有序的管理工作规范及制度，以促进我国医疗卫生事业的健康发展。非法行医，不仅扰乱了该行业已经建立的良好的医疗卫生工作管理秩序，而且非法行医现象仍呈现蔓延之势，严重威胁了人民群众的生命健康和安全，成为当前社会的一大公害。本文主要讨论了非法行医罪的主体、主观方面、疑难问题及立法完善。

On the crime of illegal practice 

In recent years, as China's socialist market economic system established, sound, health care reform to a large extent facilitate the broad masses of people for medical treatment, make up a national medical services. Medical practice is related to people's lives and health of the special job, therefore, the state's management of this industry is extremely strict. Not only on the qualifications of medical practitioners to be strictly limited to medical practitioners must have good political and ideological conditions, they also need to have a certain technical qualifications, to ensure that medical quality and protect people's lives and health and safety. But also to practise medicine, developed a set of strict and orderly management of the norms and systems, to promote the cause of China's health and healthy development. Illegal practice, not only disrupted the industry has established the good management of medical and health work order and illegal practice is still present epidemic proportions, a serious threat to people's lives and health and safety of the community to become a public hazard. This paper discussed the main body of the crime of illegal practice, subjective and difficult problems and improve the legislation.
