摘   要
     非法证据排除规则是当今世界各国普遍认同的一项证据规则，它能够很好的平衡打击犯罪和保护公民基本权利之间产生的冲突。非法证据排除规则的设立是一个国家基于对它自身的主导价值观念和对公民权利的重视程度体现，然而各个国家的主导价值观念和对公民权利的重视程度有所不同，所以关于非法证据排除规则，各国的立法时价值取舍就有所差别。从世界范围来看，主要有两种模式：一是强制排除模式，多见于美国；另一个是裁量模式，多见于英国。我国也面临着非法证据排除规则价值取舍的问题，这是我国设立和完善相关制度的根本。但是非法证据排除规则在国外已有比较成熟的制度体系，而在我国却依然处于理论探索阶段。因此，通过对国外非法证据排除规则模式价值取舍的研究，汲取其中精华价值理念，从适合我国国情的角度来完善我国相关规则。

Discussing criminal litigation procedures-The Illegal Evidence eliminating Rules
Summary
The lllegal Eivdence eliminating Rules is one of the witness regulations, which is accepted by every countries around the world at large.it is able to well balance the conflicts between crime flighting and citizen basic rights protection.The establishment of The IIIegal eividece eliminating Rules is based on a country's own dominant values conception and itsembodiment of the significance of civil rights. However these two factors vary in different countries,therefore concerning The Rules for The IIIlegal Evidence eliminating,different countries could make one's choice on dissimilar value during their act of legislating.From a global perspective,there are mainly two models:First of all, it is the mandatory eliminating model,which is mostly used in the United States and Second of all, it is the dscretionary model, which is mostly used by the Untied Kingdom.China also faced the problem with The IIIegal Evidence eliminating Rules's value choosing,this is the fundamentality for China to establish and consummate the interrelated system.Although The IIIegal Evidence eliminating Rules has already had a comparatively mature system overseas,China is still on the phase of theoretical exploration.Hence by studying foreign choices on pattern value for The IIIegal Evidence eliminating Rules and adopting the best value concept among them, to perfect our country's relevant rules from the point of view of fitting China's national conditions.
