论共同犯罪的实行过限的认定

摘   要

     目前无论是国内还是国外在对实行过限的认定上存在着很多的争议和疑问，随着社会大环境的变化和发展，在法制建设的进程当中，越来越多的关于实行过限的认定的案件的出现，呼吁我们应该重视、填补和完善这个制度，以便于司法实践和理论研究，从而对我国的刑事法律建设来贡献自己的一份力量。笔者在认真的学习和研究目前国内外的关于实行过限认定的大量文献资料以后，从便于实践的角度来研究，立足于建立一个统一的认定标准，从共同犯罪实行过限的概念出发，抓住共同犯罪谋议这一概念，从产生的时间上分为：事前谋议、事中谋议和事后谋划进行论述，确定自己的关于实行过限认定的观点和思想，而后又从内容的详尽度上进行阐述和分析，分为：确定的共同谋议和概括的共同谋议，从而进一步的论述笔者的观点，利用共同犯罪谋议来确定一个统一的认定标准。

Abstract

At present regardless of being domestic or overseas, to implements has limited recognized that on has many disputes and the question, along with the social environment's change and the development, in the middle of legislative work's advancement, more and more about has implemented case's appearance which limits recognized, appealed that we should take, fill and to consummate this system, is advantageous for the judicial practice and the fundamental research, thus contributes an own strength to our country's criminal law construction. The author in the earnest study and the research present domestic and foreign after having implemented the massive literature material which limits recognized, from is advantageous for the practice the angle to study, bases in establishes one unified to recognize the standard, implements the concept which from the joint offense limits to embark, holds joint offense planning this concept, from the time which produces divides into: In anticipation in the planning, the matter the planning and planned afterward carries on the elaboration, determined that own about has implemented the viewpoint which and the thought limited recognized, then carried on the elaboration and the analysis from content exhaustive, divided into: Determination common planning and summary common planning, thus the further elaboration author's viewpoint, the use joint offense planning determined that unified recognizes the standard .
