摘    要
       诉讼契约是由大陆法系民事诉讼法学家提出的概念，在我国又称为诉讼协议。诉讼契约除了具备契约的一般特征外，还具有它独特的本质特征。我国立法上有诉讼契约的实质规定，理论上尚未建立相关制度，但诉讼契约之所以能够存在，因为它体现了当事人的意思自治、诉讼法中的处分原则；它是公法与私法相互交融的结果，是解决民事纠纷的需要。在民事诉讼中建立诉讼契约制度，不仅是对当事人主体性的强调和确定，还能降低诉讼成本，提高诉讼效率，使纠纷以及其他程序事项能够更加灵活地得到解决。由于我国民事诉讼受职权主义模式影响，当事人之间的诉讼合意受到限制，当事人的处分自由能动性没有得到充分发挥，诉讼契约制度存在不足，因此对于如何完善我国的诉讼契约制度提出几点建议。

Disscussion on the Civil Litigation Contract
Abstract
       The litigation contract is a concept which proposed by the jurist of mainland legal systerm,is also called litigation agreement in our country.It has some unique substantive characteristcs besides has the general characteristcs of contract.Our country legislation has essential stipulation about the litigation contract, instead,ralated systerms has not yet been established in theory.But the reason that the litigation contract can exist,because it embodies the parties’ meaning autonomy,the handing principle of the parties;it is the result which the public law and the civil law blend mutually,is the demand to solve civil disputes. Establishes the litigation contract systerm in the civil litigation,not only emphasize and determine the parties’independence,but also can reduce the costs and improve the efficiency of the litigation so that disputes and other procedural matters can be solved nimbly.Under the inflence of the authoritation pattern,the handing principle of the parties embodies insufficiently,the litigation contract systerm exist defects,so there are several suggestions about how to improve our country’s litigation contract.
