浅谈德主刑辅思想的现实意义

摘   要
传统德主刑辅思想是儒家思想文化的重要组成部分，对它的研究，大多数学者通常仅从思想文化的角度进行探索，而没有真正地把德主刑辅思想与当今现实社会密切结合起来，使它的现实意义得到充分发挥。一种思想的作用在于促进社会的发展，使其积极的因素为人所用。德主刑辅思想作为古代社会的优秀法律思想，它对促进当时社会稳定和维护封建统治起到了巨大的作用，但同时也由于时代的限制，它有自身的局限性，因此，随着人类社会的向前发展，它的弊端逐渐暴露，不再适应现代社会的需求。尽管如此，对于德主刑辅思想，我们也不能全盘否定，它仍然有其精华所在，值得我们借鉴。在此，我们换一个视角，从法律制度的角度对德主刑辅思想进行再认识，分析德主刑辅思想的积极影响和消极影响，探讨它对法律制度的作用，同时，对如何处理法律与道德之间的关系做进一步的探析，进而阐述这种思想对现代法制建设的现实意义。
