浅析法家以法为本的法治理论

摘要
先秦法家是春秋战国时期的一个学派，是中国最早将“法律”二字连用，在诸子百家中他们最重视法律及其作用，以此提出了一系列相关的学说，尤其是提出了以法为本的法治理论和付诸于实践，对法律的探寻和理论的研究使得他们成为中国传统法律的主体，对中国古代法律的发展有着重要的影响和作用。本文联系时代背景对法家“法”的认识和内涵进行研究，在法家理论中是怎么看待法律法令的，尤其是在此基础上建立的“以法为本”的理论思想进行分析，从而探寻法家及其法律观，结合现代意义上的法治评析法家的这种以法为本的理论，谈一下对今天我国法制建设的现实意义。

Abstract
Legalist is one school in Spring and Autumn and Warring states period .At that time, the law has been used as a joint word in Chinese. Legalists are those who regard more about the importance role of law besides other schools and put forward some other theories related, especially for the nomocracy theory based on law and put it into practice. The exploration of law and study on its theory make them become the principal part of traditional law which has a great influence on the development of Chinese ancient law. This paper will make a research on Legalists’ meaning to” law” and the connotation and in the theory of how the legalists look at the laws and rules linked the age background, especially on this basis, the establishment of "law-based" ideological and make theoretical analysis, then seeking legalists and their legal concept, combining modern sense of the rule of law legalists’ comment on this theory to talk about China's legal construction of practical significance today.
