摘    要 
在现代行政权中，行政自由裁量权广泛存在于整个行政管理领域，成为当代行政法发展的重要标志。行政自由裁量权是一柄双刃剑：运用该权力一方面可以提高行政效率，便于行政管理；另一方面滥用该权力又会滋生行政腐败，损害相对人的合法利益。为了提高行政效率，以适应现代行政管理的要求，实现依法行政，必须扩大行政自由裁量权，而行政自由裁量权的扩大势必会造成滥用，因此，有必要对行政自由裁量权进行研究，通过各种监督来控制行政自由裁量权，防止其失控，保证社会主义法制建设顺利进行。
本文采用理论和实际相结合、比较分析等研究方法对行政自由裁量权进行研究。^论文主要谈了四个问题，第一个问题阐述了行政自由裁量权的概念和特征等理论。第二个问题分析了行政自由裁量权存在和发展的必然性和必要性。第三个问题论述了行政自由裁量权和依法行政的关系。第四个问题论述了对行政自由裁量权的监督。

On the Power of Administrative Discretion and its supervisory
Abstract
       In the modern administrative power, the administration discretion extensively exit in the field of the administration,and become important sign of the contemporary development administrative law too. The administration discretion is one double-edged sword:on the one hand,use the authority to be able to improve administrative efficiency and easy to administration;On the another hand,if' abuses that authority may propagate administration sepsis,damage legal benefit of relative people. In order to guarantee the administrative efficiency,to meet the needs of the modern administration and to realize the administration of the state according to law,the administrative discretion easily causes the abuse of the administrative discretion.so, The administrative discretion has to be researched. In order to prevent administrative discretion from being abused,all kinds of treasure must be taken. It is Guaranteed that the socialist legal system construction carries on smoothly.
This thesis takes the methods of the integration of the theories and the practice,and the comparatives analysis to analyze and study the control of the administrative discretion.It talks four questions:The first question discussed the theories of the definition and character;The second question analyzes the inevitability of the administrative discretion and the need of control of the administrative discretion in China;The three question on the administrative discretion of the administration according to law and relations;The four question put forward three ideas:perfecting the administrative legislation,strengthening the administrative self-control,improving the judicial control in order to perfect the design of it.
