论朱元璋的法律思想及当代启示

摘要

 朱元璋在巩固其王朝统治的法制建设中，朱元璋以高度的理性，“鉴古为治”，从多方面重新建立制度，厘定政策，使明初的经济得于恢复发展、社会秩序得于稳定、封建统治得于巩固。在法律方面，根据时局的变化和巩固政权的需要，制定了比前代更为严密的法律制度，就其法律思想而言，可以说是独步古今。其中，在法律思想的建制方面，朱元璋鉴于元“以宽失天下”的事实，以重典治国作为法律思想的核心，并据此颁行了一系列相关法典，由此开启了大明三百年江山，亦为我们今天如何借鉴历史智慧、开展法制建设，建设社会主义法制国家提供参考和借鉴。本文拟从朱元璋的法律思想入手，寻找其可称之处，为当今的普法教育和法制宣传提供历史依据。

Inspire by Zhu Yuanzhang's Legal Thought and the Present Age

Abstract:Zhu Yuanzhang in consolidates its dynasty rule in the legislative work, Zhu Yuanzhang take the high rationality, “reflects ancient as governs”, from various establish rules, arranges the policy again, makes beginning of Ming dynasty's economy to resume the development, the social order in stably, the feudalism to rule consolidated. In the legal aspect, according to the current political situation change and the consolidated political power's need, has formulated compared to before the generation of stricter legal regime, speaking of its legal thought that may say that is the unique ancient and modern. And, in the legal thought's organic aspect, Zhu Yuanzhang in view of the fact that the Yuan “loses the world by the width” the fact, takes the legal thought by the severe laws governing the core, and has issued and executed a series of related statute books according to the above, from this has opened a Ming Dynasty 300 year landscape, also how today to profit from the historical wisdom, the development legislative work for us, the build socialism state with an adequate legal system provides refers and uses for reference. This article plans from Zhu Yuanzhang's legal thought to obtain, to seek its may call the place, provides the historical basis for the now legal education program and the legal system propaganda.
