从公务员司法救济谈公务员法律地位

摘   要
     司法是社会公正的最后防线，是保障公务员法律地位的重要救济方式，然而，我国目前保障公务员法律地位的救济机制尚不健全，存在着疏漏。公务员合法权力被侵害的现实性，司法救济保障的局限性和公务员自我保护意识以及法律意识谈薄等问题依然严重存在。因此，必须充分认识建立司法救济保障公务员地位制度的重要性，并通过扩大行政复议，行政诉讼受案范围，扩大行政赔偿范围以及完善行政行为监察等以保障我国公务员法律地位。

The official judicature relief

ABSTRACT

The judicature is the social equity in the final protective line, which is the important relief way in safeguarding the official legal status   however, in our country safeguarded the official legal status of the relief mechanism is not perfect and has the oversight at present. The official legitimate authority the feasibility which is violated, the judicial relief safeguard limitation and the official protects oneself to realize as well as the legal awareness discussed very thin and so many questions still seriously exist. Therefore, we must understand fully the establishment judicature relief safeguards the official status system is very importance, and reconsiders through the expanded administration, and administrative proceedings the document scope, the expanded administration compensation scope as well as the consummation administrative action supervision and so on to safeguard our country official legal status.
